Restrictive covenants

Ensuring our developments are great places to live...

Ashford Homes consider their developments to be the start of a new community and, as one of its homeowners, you are part of that community, helping shape its future, ensuring the development becomes a great place to live and enjoy. Understanding your role as a resident is an important part of that process.

Attached to the deeds of your new home are certain rules, known as restrictive covenants, regarding what you can and can’t do with your home and the development surrounding it. These are placed on the whole development for the benefit and enjoyment of all the residents.

Restrictive covenants can cover anything from adding a satellite dish to your home to parking restrictions. All properties on the development will have the same covenants and all residents will have agreed to them as part of their contract.

You solicitor should explain the details of the restrictive covenants relating to your new home so that you can understand the implications to avoid any problems in the future.

If you think one of your neighbours may be breaking any of the restrictive covenants and it is affecting you or your family, we recommend you attempt to politely broach the subject with them first. However, if you are unable to reach an agreement with your neighbour then you should consult your solicitor for advice, as Ashford Homes are not able to police or enforce the covenants.

If you do not have a copy of the restrictive covenants your solicitor will be able to supply it for you.
